SERVICES

Petosa Law LLP (“Firm”) seeks to thoroughly understand its clients and is guided accordingly in providing outstanding service to fulfill their needs and requirements.

The Firm is AV rated with Martindale Hubbell and has a long history of working with lenders and servicers to get the job done. The Firm was an Iowa go-to firm utilized extensively by the FDIC and the RTC during the eighties and nineties to procure, sell and work out distressed assets resulting from the financial collapse of savings and loans across the state.

During the last two decades the Firm has been a leading Iowa law firm providing foreclosure, bankruptcy and related services to prominent lenders and mortgage servicers. We are a long-time member of the USFN and actively utilize its educational opportunities as well as participate in its Loan Management and Servicing Seminars.

STAFFING

The Firm provides dedicated, specialized staff and the latest technology to service the needs of all clients. We embrace the use of technology and have highly educated and trained attorneys, paralegals and other support staff who are specialists in providing the mortgage servicing industry with foreclosure, bankruptcy, loss mitigation, eviction and REO services. Our approach is to leverage the use of the latest technology to best serve the needs of and communicate with our clients.

Staffing is maintained at a level to ensure periodic changes in caseload volume can be managed to meet the needs of all clients. One manager is dedicated to workflow and timeline management and continually assesses staff capacity, workload balance and case assignment. Technology enhancements are implemented on a regular basis to maximize efficiency.

Written job descriptions and procedures are maintained and updated regularly; new hires are consistently trained by one manager and attorneys provide an overview of our services and goals; bi-weekly staff meetings deal with specific client requirements, updates in the law and procedural changes; annual training generally consists of a week-long series of sessions based on specific areas of skill efficiency, updates in the law and procedural changes. The Firm offers competitive wages, benefits and profit sharing.

PROCEDURAL

Multiple title providers, abstracters, process servers/sheriffs are used in the course of foreclosure and eviction proceedings throughout the State of Iowa, depending on location of the property as well as cost effectiveness and timeliness of requested services. Management performs initial and on-going due diligence for all vendors and requires confidentiality agreements and contracts as applicable.

We adhere to the record retention guidelines set forth by our individual clients. In general, archived files contain only client referral data and copies of documents filed for public record. Original documents, while in our possession, are stored in a secure fireproof cabinet; original notes and mortgages are filed with the courts if a foreclosure case proceeds to judgment and returned to the client by overnight delivery if a case is dismissed.

All client procedures are reviewed on an ongoing basis and attorneys and staff are trained regarding specific procedures for FDCPA, SCRA and other laws regarding consumer compliance; specific procedures are followed for client requirements in handling customer complaints and media contact.
